History keeps repeating itself and the South
Glens Falls school District continues to get
hammered. Mrs. Philo was elected a second
time for the BOE VP seat, during the July 21st,
regularly schedule meeting. The first
election was deemed null and void after it
was found the first election, conducted by
secret ballot, was illegal.
Pub. Off. Law 87(3)(a) requires that records
of votes must include the final vote of each
board member on every matter voted on. It
further notes that "Secret ballots are not
allowed for any purpose (Smithson v. Illion
Housing Auth, 130 A.D.2d 965 (4th Dep't
1988)........not even at a board's
organizational/reorganizational meeting
regarding the election of board President
and Vice-President and other officers."
One would expect,
someone on the board would have been aware
of this rule, at the very least our
Superintendent, Dr. McCarthy. Instead, the
illegal practice was uncovered during a
NYSSBA, BOE training session.

responsibilities are advisory; to approve or
disapprove the financial documents produced by those
charged with fiscal duties: the district Business
Manager, District Treasurer and staff. It is not
the responsibility of a BOE member to organize,
analyze and sort such information"
